名嘴朱學恒今前往台北地檢署，就性騷台北市議員鍾沛君自己告發自己，告發狀卻寫得語焉不詳，曾任主任檢察官的律師薛維平懷疑，朱學恒這樣做是要逼鍾沛君「上戰場」到北檢應訊，同時告進地檢署後，還能藉由偵查不公開作業辦法和性騷擾防治法相關規定，讓司法單位和媒體和都不得繼續洩漏或報導其性騷案，其心可議。

薛維平指出，朱學恒在餐廳趁酒後強吻鍾沛君，完全符合性騷擾防治法第25條「意圖性騷擾，乘人不及抗拒而為親吻、擁抱或觸摸其臀部、胸部或其他身體隱私處之行為」，可處2年以下有期徒刑、拘役或科或併科新臺幣10萬元以下罰金。當中並未涉及使人不能抗拒的強制部分，因此沒有強制猥褻的問題。

薛維平表示，刑事訴訟法中的「告發」，只有被害人或第三人才能告發，且告發也須申報犯罪事實，如果真的有人「自己告發自己」，只能認作是「自首」或「投案」，法律上很難叫「告發」。

其次，朱學恒的告發狀上看似未提及具體犯罪事實，內容不知所云，到底是有親、沒親？還是斷片？告發狀上都沒寫到。而告訴乃論之罪，告訴期間只有6個月，不免讓人懷疑是算準告訴期間已經過了嗎？

薛維平質疑，朱學恒之所以告發自己，可能是受不了輿論每天攻訐，決定逼鍾沛君「上戰場」，也就是寧可逼鍾到地檢署提告，也不要每天在外面凌遲他。更重要的是，只要朱學恒到北檢告發自己並成案，便可藉由偵查不公開作業辦法和性騷擾防治法，堵住眾人悠悠之口。
